FOCUS on Emerging Issues:
Since 2009, over $1.2 trillion in foreign investment has flowed into U.S. real estate—driving a surge in state and federal legislation. In 2025 alone, 149 bills were introduced across 36 states and Congress, with 21 states enacting restrictions to
date. Motivated by national security and agricultural concerns, states like Arkansas, Kentucky, and Tennessee are leading the charge, while Congress considers a more unified response.

FOCUS on Financial Services Policy:
|
This session, 20 mortgage trigger lead bills have been introduced in 10 states, and six of those have been enacted in six states. The bills include provisions making the use of trigger leads an unfair or deceptive business practice if the solicitor doesn’t clearly and conspicuously disclose the use of a trigger lead and that they are not affiliated with the lender the consumer applied with.
